Terms of sale
Plain-English terms for reserving a bike, buying from our online shop, and test rides.
These terms apply when you reserve a bike, buy something from our online shop, or take a test ride with First Bikes Clacton ("we", "us"). Our address is1 Sadds Yard, Skelmersdale Road, Clacton-on-Sea,CO15 6BP. They do not affect your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
1. Reserving a bike
You can reserve a bike listed on our website by paying a deposit through our card payment page, run by Stripe. The deposit amount is shown before you pay.
- Paying the deposit asks us to take the bike off sale straight away and hold it for you for the period shown, normally thirty days. By ticking the box on the reservation form you ask us to start holding the bike immediately rather than waiting for a cooling-off period.
- The deposit is deducted from the price of the bike when you buy it.
- If you change your mind, or do not complete the purchase within the reservation period, the deposit is not refunded. It covers our cost of holding the bike and turning other buyers away.
- If we cannot sell you the bike, for example because it was sold in the shop before your payment reached us, or we find a fault we cannot put right, we refund the deposit in full.
- Ask us if you need longer than the reservation period. We will usually extend it.
You will see the bike, hear it running and can take a test ride before paying the balance. Nothing obliges you to buy a bike you are not happy with, but the deposit terms above still apply.
2. Buying a bike
The balance is paid in the shop, by card, bank transfer or cash. Ownership passes to you when the full price has been received. We complete the V5C change of keeper with you at the time of sale. Every bike we sell has a valid MOT where one is required and has been checked in our workshop; we tell you what has been done.
3. Orders from the online shop
- Prices are in pounds sterling. We are not VAT registered, so no VAT is added or shown.
- Postage is charged at the flat rate shown at checkout, or you can choose free collection from the workshop.
- You have the right to cancel an online order within 14 days of receiving it, for any reason, under the Consumer Contracts Regulations 2013. Tell us by email or phone and return the item unused, in its original packaging, within 14 days of telling us. We refund the price and the standard postage within 14 days of receiving the item back. Return postage is your cost unless the item is faulty.
- Helmets and other safety equipment that has been worn cannot be returned for a change of mind, for hygiene and safety reasons, unless faulty.
- Faulty goods are covered by the Consumer Rights Act 2015: repair, replacement or refund as the law provides.
4. Test rides
Test rides are at our discretion and need a full, valid driving licence for the class of bike. We take a photograph of the licence and your details, keep the photograph for a short period as set out in ourprivacy policy, and ask you to sign a short agreement on the day making you responsible for the bike while you ride it.
5. Complaints
Talk to us first: 01255 427851or admin@firstbikesclacton.co.uk. Most things are sorted with a phone call.
